These are the rules for using Born in the City (borninthecity.com). By visiting or creating an account, you agree to them. If you don’t, please don’t use the site — that’s the simplest answer.
What this site is
Born in the City (“BITC,” “we,” “us”) is an independent Broadway and Off-Broadway information site run by a third-generation New Yorker. We publish lottery picks, ticket guides, show news, and a weekly newsletter. We are not affiliated with any Broadway show, theater, lottery operator, or ticket vendor. We don’t sell tickets. We don’t issue lottery codes. We don’t issue refunds.
What we try to do, and what we can’t promise
We do our best to keep show information, lottery details, and showtimes accurate and current. We can’t promise it always is. Schedules change. Lotteries close. Shows get cancelled. Theater sites are sometimes wrong. If something on BITC is wrong, we’ll fix it when we find out, but you should always confirm critical details (start times, ticket availability, lottery deadlines) with the official source before showing up at a theater.
By using the site, you agree we are not liable for:
- Losses from missed lotteries, sold-out shows, or schedule changes
- Decisions you make based on what you read here
- Anything that happens on third-party sites we link to
In short: we’re a helpful guide, not a ticket vendor or guarantor.
Your account
If you create a BITC account, by email/password or by signing in with Google or Facebook:
- You’re responsible for what happens under it. Keep your password private.
- Don’t share your account with anyone else.
- Don’t create multiple accounts to game any system — though to be clear, the “system” here is mostly just receiving emails.
- One person, one account.
- If you signed in with a third-party identity provider, that provider’s terms also apply to your linked account.
We may suspend or delete accounts that violate these terms — usually after asking what’s going on first.
Acceptable use
When using BITC, please don’t:
- Scrape the site programmatically beyond what robots.txt allows.
- Republish substantial site content elsewhere without credit and a link back.
- Commercially exploit lottery information for resale (winning a lottery and selling those tickets is also forbidden by the lottery operators — that’s between you and them).
- Attempt to access parts of the site you’re not authorized to access.
- Use the site to harass, threaten, or harm others.
- Upload malware, attempt SQL injection, brute-force passwords, or otherwise behave maliciously.
Content ownership
BITC’s editorial content — the words we write, photos we created, layout and design — is owned by BITC. You can read it, share it on social, and link to it. You may not reproduce it in bulk without permission. Production photography belongs to the productions and photographers credited; we license those images or use them under fair use.
If you submit anything to BITC (a comment, a contact-form message, a tip), you give us permission to use it — including for editorial purposes — without owing you anything in return. We won’t share your email address with anyone.
Third-party sites
BITC links to other sites: Lucky Seat, Broadway Direct, TodayTix, Playbill, Telecharge, individual show websites, and others. We don’t run those. Their terms apply when you visit them. We are not responsible for what they do, charge, change, or break.
Newsletter and emails
If you sign up for our newsletter or lottery alerts, we’ll send you emails about Broadway lotteries, shows, and BITC content. Every email includes an unsubscribe link. We don’t sell email lists. See our Privacy Policy for details on how we handle your data.
Changes to these terms
We may update these terms. When we do, we’ll update the “Last updated” date at the top. Material changes — anything that meaningfully restricts your rights — will be announced on the site. By continuing to use BITC after changes take effect, you agree to the updated terms.
Termination
You can stop using BITC at any time. If you have an account, you can delete it from your account settings (or email us to delete it for you). We can suspend or terminate accounts that violate these terms or abuse the site.
Disclaimer of warranty
The site is provided “as is” and “as available.” We don’t promise it’s error-free, always reachable, or fit for any particular purpose. Use it at your own risk.
Limitation of liability
To the maximum extent permitted by law, BITC and its owner are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the site — missed shows, lost tickets, hurt feelings, or anything else. If a court ultimately decides we are liable for direct damages, our total liability is capped at $50 or whatever you paid BITC in the prior twelve months (which is also $50 for everyone, because we don’t charge anything).
Governing law
These terms are governed by the laws of the State of New York, without regard to its conflict-of-law principles. Any disputes will be resolved in a state or federal court located in New York County, New York.
